1. Introduction
Welcome to Obserc.
These Terms & Conditions (“Terms”) govern your use of the Obserc mobile application and related services (the “Service”).
Obserc provides personal safety tools including safety alerts, location sharing, trusted contact networks (“Circles”), and safety communication features such as Night Out Mode and SOS Beacons.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service.
2. Eligibility
To use Obserc you must:
• Be at least 13 years old or the minimum legal age required in your jurisdiction
• Have the legal authority to agree to these Terms
• Provide accurate account information
If you are under the age of majority in your jurisdiction, use of the Service must be supervised by a parent or guardian.
3. Account Registration
Certain features require creating an account.
You agree to:
• Provide accurate and current information
• Maintain the confidentiality of your login credentials
• Notify us immediately of unauthorized account use
You are responsible for all activity that occurs through your account.
4. Circles and Trusted Contacts
Obserc allows users to create groups called Circles, which consist of trusted contacts who may receive alerts, notifications, or location updates.
By using Circles you acknowledge that:
• You are responsible for selecting trusted contacts
• Information shared in Circles may include safety alerts and location data
• Circle members may receive notifications when safety features are activated
Obserc is not responsible for how Circle members respond to alerts or use shared information.
5. Safety Features
Obserc includes safety tools designed to help users communicate quickly with trusted contacts.
These may include:
• Night Out Mode
• SOS Beacons
• Critical SOS alerts
• Find Your Squad
• Safety calls
• Emergency call access
These tools are designed to assist communication during uncertain situations.
They are not a replacement for emergency services, law enforcement, or professional assistance.
Users should always contact emergency services when facing an immediate danger.
6. Emergency Response Disclaimer
Obserc does not provide emergency services.
Activating safety features such as an SOS Beacon or Critical SOS does not guarantee that emergency services will be contacted or dispatched.
Alerts sent through the Service are delivered to users within your Circle or to contacts designated by you.
Response times and outcomes depend on factors outside our control, including:
• Device connectivity
• Notification delivery
• Availability of recipients
• Location accuracy
Users should never rely solely on the Service in emergency situations.
7. Location Data and Accuracy
Certain features rely on location data provided by your device.
You acknowledge that:
• Location data may not always be precise or accurate
• Location services depend on device settings, GPS signals, and network connectivity
• Obserc cannot guarantee the accuracy, completeness, or timeliness of location data
Users should not rely exclusively on location information provided by the Service.
8. Technology Limitations
The Service relies on mobile networks, device hardware, operating systems, and third-party infrastructure.
These systems may occasionally experience:
• Service interruptions
• Delayed notifications
• Connectivity failures
• Software errors
Obserc cannot guarantee uninterrupted or error-free operation of the Service.
9. Acceptable Use
You agree not to:
• Use the Service for illegal or harmful activities
• Misuse safety features to harass or deceive others
• Interfere with or disrupt the platform
• Attempt to gain unauthorized access to other accounts or data
We may suspend or terminate accounts that violate these rules.
10. Third-Party Services
The Service may rely on third-party services such as:
• Cloud hosting providers
• Notification delivery services
• Location services
• telecommunications infrastructure
Obserc is not responsible for failures or interruptions caused by third-party systems.
11. Intellectual Property
All software, branding, design elements, and content associated with Obserc are owned by or licensed to Obserc.
You may not copy, reproduce, distribute, or reverse engineer any part of the Service without prior written permission.
12. Limitation of Liability
To the maximum extent permitted by law, Obserc and its operators shall not be liable for:
• personal injury
• loss of life
• property damage
• emotional distress
• lost profits
• indirect or consequential damages
arising from the use or inability to use the Service.
The Service is provided “as is” and “as available.”
13. Indemnification
You agree to indemnify and hold harmless Obserc, its operators, employees, and partners from any claims, damages, or liabilities arising from:
• your use of the Service
• violation of these Terms
• misuse of safety features
• disputes between you and other users

We are not liable for any changes or discontinuation of features.
15. Termination

• misuse the platform
• create risks for other users
Users may also delete their account at any time.

17. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Ireland, without regard to conflict-of-law principles.
